1. Scope
edel+stahl DESIGN GmbH operates a store (referred to below as "edelstahldepot.de").
The business transaction and delivery is carried out exclusively according to the following general terms and conditions. All contracts concluded on the basis of the offers on our Internet store page are based on these General Terms and Conditions.
Various functions of our websites are only fully accessible if you have the latest version of the Flash Player.
If working days are specified as deadlines, this includes all weekdays with the exception of Saturdays, Sundays and public holidays.
2. Offers and contract conclusion
The presentation of the products in our store system is not a legally binding offer, but a non-binding online catalog. By clicking on the button "Buy" / "Order subject to payment" you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after sending the order and does not constitute an acceptance of the contract. We can accept your order by sending an order confirmation by e-mail or by delivering the goods within two days.
We also accept orders by letter, postcard, fax or e-mail. For orders placed with us by telephone, we assume no liability under any circumstances; transmission errors are the responsibility of the customer.

4. Right of withdrawal
You have the right to cancel this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken or has taken possession of the goods. inform us by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to revoke this contract. You may use the attached sample revocation form, which is not mandatory. In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.
Consequences of revocation:
If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day you notify us of the cancellation of this agreement. This period shall be deemed to have been observed if you send the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods. You will only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

5. Withdrawal in case of unavailability
edel+stahl DESIGN GmbH is entitled to withdraw from the contract if the goods ordered are not available through no fault of edel+stahl DESIGN GmbH. In this case, edel+stahl DESIGN GmbH will inform the customer without delay about the non-availability and reimburse the customer's counterperformance without delay.
6. Prices and deliveries
All price quotations include all taxes including value added tax (VAT) of 19% and other price components. Within the EU we charge with the currently valid value added tax, outside the EU without value added tax (VAT). In addition, delivery and shipping costs are incurred and are shown separately in the context of the specific offer. We reserve the right to change the construction, form, design and price without prior notice. In the event of price changes, you will be charged the price valid on the day of delivery.
All national shipments: From 80 Euro order value we deliver with DHL or DPD free of charge as standard.
The terms of delivery, the delivery date as well as any existing delivery restrictions can be found under a correspondingly designated button on our website or in the respective item description. If the buyer wants to make use of his right of withdrawal and return the goods to us, we will issue a credit note for the already paid goods and send the already paid amount back to him. In this case the shipping costs incurred by the seller will be deducted from the credit note. This regulation also applies if the goods were purchased "free of shipping costs", i.e. from a certain value of goods via our online store.
If the transport company returns the shipped goods to the seller because a delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment. This does not apply if the customer effectively exercises his right of revocation, if he is not responsible for the circumstance that led to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless the seller had given him notice of the service a reasonable time in advance..
If the buyer is a consumer, the risk of accidental loss or deterioration of the sold goods, even in the case of mail order purchases, is only transferred to the buyer upon delivery of the goods. If the buyer is an entrepreneur, this risk is transferred to the buyer upon delivery of the goods to the forwarding agent, carrier or other person designated to carry out the shipment. The handing over is equal if the buyer is in default of acceptance.
7. Payment, default of payment, default of acceptance
The customer has various payment options available, which are specified in the online store of the seller. If prepayment has been agreed upon, payment is due immediately after conclusion of the contract.

Our invoices are payable - irrespective of receipt of the goods and without prejudice to the right of notification of defects - within 7 days of the invoice date. If edel+stahl DESIGN GmbH nevertheless delivers against invoice, default with the consequence of payment of default interest will occur no later than 30 days after delivery and receipt.

If edel+stahl DESIGN GmbH nevertheless delivers against invoice, default with the consequence of payment of default interest will occur no later than 30 days after delivery and receipt of an invoice or equivalent payment schedule. In the event of default, edel+stahl DESIGN GmbH will charge interest at a rate of 5 percentage points above the prime rate, for entrepreneurs 8 percentage points above the prime rate. This does not affect edel+stahl DESIGN GmbH's right to claim further damages. After expiry of the period, the customer will be in default without reminder.
8. Retention of title
edel+stahl DESIGN GmbH reserves title to the delivered goods until full payment of the purchase price. In the case of contracts with entrepreneurs, edel+stahl DESIGN GmbH reserves title to the delivered goods until all claims arising from an ongoing business relationship have been settled in full.
9. Warranty and liability, offsetting, assignment
The warranty is based on the legal regulations and is 2 years, if the customer is not a consumer, the warranty is limited to 1 year. The warranty period begins with the delivery of the goods.
If there is a defect in the delivery or service, the warranty claims are initially limited to subsequent performance. If subsequent performance fails, the customer has the statutory claims, namely he is entitled at his discretion to withdraw from the contract or to demand a corresponding reduction of the remuneration (abatement). edel+stahl DESIGN GmbH is not liable for damage caused by incorrect or improper use of the products. The provisions of the German Product Liability Act shall remain unaffected by this.
In commercial business transactions, it is necessary that the commercial customer has properly fulfilled his inspection and complaint obligations in accordance with §§ 377, 378 HGB.

The assignment of claims against edel+stahl DESIGN GmbH under this contractual relationship is only permissible with the latter's prior written consent. This does not apply if the legal transaction which gave rise to the claim is a commercial transaction for both parties or if the debtor is a public law entity or a public law special fund.
10. Privacy
Insofar as you do not give your express consent to a more extensive collection/processing/use of your data in individual cases, the following applies:
edel+stahl DESIGN GmbH only collects the personal data entered during the ordering process in order to be able to carry out the purchase contract with you, namely your name, address, e-mail address, and also, if you provide information voluntarily, your body measurements, your company, form of address, telephone number, fax number, VAT number, delivery addresses. If you pay by credit card, your credit card data will also be collected. edel+stahl DESIGN GmbH stores the data exclusively for processing and handling your order and only within the scope of the statutory provisions. The data will only be transmitted to third parties if this is necessary for the execution of the purchase contract and delivery. The text of the contract is not stored by us and cannot be retrieved after completion of the ordering process. However, you can print out the order data immediately after sending it.

13. Complaints procedure
